Fatal shooting in Deltona involved deputy

A man was shot and killed by a deputy in Volusia County on Thursday, according to the Volusia County Sheriff's Office.  

Deputies received a call that a man was acting strangely inside a RaceTrac gas station on W. Finland and Saxon Blvd. in Deltona.  They arrived to find a Hispanic man inside the bathroom.

According to the Sheriff's Office, a deputy saw drugs on the sink of the bathroom and attempted to arrest the man.  A second deputy arrived to help, but the man grabbed a deputy's taser, said investigators.

"Just as they went to put that second handcuff on him is when he now decides he is not going to go peacefully," explained Volusia County Sheriff Mike Chitwood, "and once he got in control of the deputy's taser, there's really nothing you can do."  

The sheriff said, had the man had complied with orders from the deputies, there would have been a far different outcome.

"You cannot challenge law enforcement," he said.  "Obey the commands and everything ends peaceably."

The identity of the shooting victim has not been released. The deputy who took the fatal shot has been placed on paid leave while the Florida Department of Law Enforcement investigates.
