Suspect in deputy's shooting wants case dismissed
BREVARD COUNTY, Fla. (WOFL FOX 35) - The man accused of trying to kill three Brevard County Sheriff's Office agents back in 2015 is trying to get the charges tossed.
John DeRossett has filed immunity from prosecution, claiming he mistook the agents who had come to arrest his niece as kidnappers.
The agents went to Derossett's home in Port St. John to take his niece into custody for an alleged prostitution charge. That's when they said Derossett started shooting. One of the men, Agent John “Casey” Smith, was hit but but survived.
A hearing, similar to a "stand your ground" defense is set for later this month.
