Orange County mom sues school district over son’s alleged sexual assault in elementary school

ORLANDO, Fla. - An Orange County mom is suing the school district. She claims her 9-year-old son was sexually assaulted at his elementary school.
What we know:
The 9-year-olds mother is claiming her son was sexually assaulted in a bathroom at Chickasaw Elementary School in 2022.
According to the lawsuit, the boy was using the bathroom when a fellow student entered his stall and forced himself upon the boy. The lawsuit also stated that the fellow student threatened to stab the boy if he didn’t let the other student touch him.
Court records show that a teacher eventually walked in, and the other student crawled into a stall next to the boy’s with his pants down.
"Chicksaw (sic) Elementary School’s negligent supervision of (the 9-year-old boy) caused and contributed to this horrendous act of sexual violence by (his fellow student)," the lawsuit reads.
As a result of the incident, the lawsuit accuses Orange County Public Schools of negligence and failing to keep the boy from harm.
The lawsuit states it's seeking damages of over $50,000 in compensation.
FOX 35 reached out to Orange County Public Schools about the lawsuit, OCPS replied with the following statement: "The Office of Legal Services has not been served with any complaint. Also, the district does not comment on pending or potential litigation."
