Man killed after shooting at Volusia County deputies during traffic stop

Volusia County deputies shot and killed a man during a traffic stop late Monday, the Sheriff's Office said.

That man has been identified as 26 year-old Timothy Wagner from Marion, VA.

The Sheriff's Office also released the names of the deputies involved in the shooting Tuesday morning.

Deputy William Kretzer conducted the traffic stop and Deputy Daniel Sweeley responded as back up.

The incident happened at 11:29 p.m. Monday night on S.R. 40 just west of County Road 3 in Pierson.

Investigators told FOX 35 that Kretzer pulled over the 2006 GMC truck because it had a burned out tail light.

The Sheriff's Office said that Deputy Sweeley was talking to the pregnant driver of the truck, 19 year-old Shannon Murphy when the male passenger pulled out a gun and fired at both deputies.

"Both deputies returned fire, striking the male passenger," Gary Davidson said in a news release.

"He was pronounced dead inside the truck, where two guns were recovered," Davidson said.

Murphy was struck in the shoulder by a bullet.

A Sheriff's Office helicopter airlifted the Murphy to Halifax Health Medical Center in Daytona Beach for treatment of her injury.

Investigators said it's unknown at this time who shot her.

It was revealed through the course of the investigation that the truck had been reported stolen from the Florida Panhandle. 

Murphy is cooperating with authorities and charges against her are pending.

Neither deputy was injured in the shooting.

Both deputies will be temporarily placed on administrative leave with pay, as is customary in officer-involved shootings.

Deputy Kretzer has been with the Volusia County Sheriff's Office since 2002,and Deputy Sweeley since 2011.

The Florida Department of Law Enforcement will investigate the shooting, which is standard practice.

The Medical Examiner's Office will perform an autopsy on Wagner Tuesday.
