Intoxicated woman arrested after crashing into vehicle while minors were in the car
ORLANDO, Fla. (FOX 35 WOFL) - A woman was arrested after crashing into a vehicle while intoxicated and with minors in her vehicle.
The Orlando Police Department reported that on January 21st, deputies were dispatched to the intersection of West Colonial Drive and North Tampa Avenue in reference to a vehicle crash. One of the vehicles in the crash, a blue 2004 Chevrolet Malibu bearing the Florida tag #IYGA33, had left the scene and had stopped at the intersection of Stryker Street and Peterson Place.
Deputies then headed to Stryker Street and Peterson Place, where they say they saw the defendant, Luvasia McCreay, speaking with an officer. Luvasia only had a Florida Learner's Permit and had a distinct orbital sway while speaking.
Deputies say that a witness to the incident, Jonas Berlus, completed a sworn witness statement advising that he saw Luvasia's vehicle strike another car on West Colonial Drive. He also witnessed Luvasia leave the scene of the crash without stopping to render any aid or exchange information.
After observing Luvasia's behavior and smelling alcohol on her breath, the deputy said that he told her he was launching a DUI investigation. While at first she was hesitant to do so, she eventually completed three field sobriety exercises.
After the completion of the exercises, the deputy says that probable cause existed to arrest Luvasia for DUI and DUI while accompanied by a minor.
The report states that the deputy did not observe any child car seats in Luvasia's vehicle or trunk, but he did find an empty bottle of Malibu Black under the driver's seat. The deputy also spoke with the minor in the vehicle, who advised that two of her brothers were in the front passenger seat during the crash. One of them had slid onto the floor during the crash and the airbags had deployed. Neither sibling were in a child restraint seat.
Another witness to the incident, Sonya Poteat, wrote a sworn written statement advising that she had observed three kids outside of Luvasia's vehicle who said to her "Help my Mommy-- we've been in an accident, please help my Mommy.
Luvasia was reportedly taken to the Orange Coutny Sheriff's Office DUI Center. She provided deputies with a breath sample, which found that she blew at 0.147. She was then transferred the BRC without incident.
