UCF student accused of sexual battery; another suspect sought

- A member of the Alpha Tau Omega fraternity at the University of Central Florida is facing some serious allegations, which police say stem from a party held at the ATO house in July.

Alexander Garces, 22, of Merritt Island, appeared before a judge on Tuesday on charges of sexual battery and false imprisonment.

According to an arrest report, the victim was attending the "New Years in July Party" on July 22 with friends and met Garces and a second man, whom police say is a UCF graduate.

Police say Garces invited the victim upstairs with the other man, and once in the bedroom, the victim told police that Garces became "very aggressive."  According to police, the victim performed a sex act on Garces, hoping that would prevent an assault. The reports states that the victim began "pulling away" and then fell after being pushed by Garces.  

The report states that the victim punched Garces in the ribs.  At some point, the victim says Garces left, and then the victim says she was sexually assaulted by the other unknown man.

Alpha Tau Omega released a statement, which read in part, "Officials with the Alpha Tau Omega fraternity learned of the police investigation on Saturday, and the chapter immediately suspended the man. ATO is conducting an internal investigation and will assist local authorities and university officials as requested."

At Tuesday's hearing, Garces elected to seek a private attorney.  Now, authorities are searching for the second man.

It remained unclear if the fraternity chapter would face any disciplinary action.
