ST. AUGUSTINE, Fla. (WOFL FOX 35) - Michael and Thalia Otto were just 8 and 9 years old, respectively, when they disappeared in October 2013. Their stepfather, Luis Toledo, is convicted of first-degree murder in their deaths.
Prosecutors say Toledo was so mad about his wife cheating on him, he killed them. Now, a jury will decide if Toledo will get life in prison without parole or the death penalty.
"The evidence shows he killed the mom of these two in a fit of rage and once she was gone he killed the two children," a state prosecutor told the court on Wednesday.
Toledo's lawyers said he has attention deficit hyperactivity disorder (ADHD) and is bipolar.
"A scan of his brain showed his brain is in fact abnormal," said a defense attorney. "He has suffered a number of concussions through his life."
Toledo admitted to killing his wife, Yessenia Suarez, in self-defense. The jury convicted him on a second-degree murder charge for her death. None of the bodies have every been found.
Closing arguments are expected Thursday, and the jury will deliberate Friday.
