Construction worker accused of attacking boss

DEBARY, Fla. (WOFL FOX 35) - Authorities in Volusia County say a construction worker and his site supervisor got into an argument that turned criminal.  It happened on Wednesday at a work site off of U.S. Highway 17/92 in DeBary.

Deputies were called to the site of the future Walmart Neighborhood Market around 7 a.m.   They say worker Erick Cox was operating a front-end loader, when he and site supervisor Perry Byrd got into an argument. 

Cox told deputies that Byrd threatened him and yelled profanities at him.   Witnesses say Cox got so angry that he dumped a large load of dirt on top of Byrd, burying him up to his neck.  Workers say Cox then got out of the front-end loader, grabbed a six-foot level and hit Byrd in the head so hard, he was knocked unconscious. 

One man called 911.   "The guy's trying to kill him on my job. Please send somebody out here," the caller told the dispatcher.
 
Cox says he was defending himself.  Deputies arrested Cox on charges of aggravated battery. Byrd was taken to the hospital with severe head injuries, where he remains in serious condition.
